“The CIRT investigation has been sent to my office for review,” said Mesa County District Attorney Dan Rubenstein, in an email to the author. A Chief Deputy District Attorney, “assigned the case … has scheduled a presentation for Tuesday of next week.”

The DA will then decide “whether or not to file charges,” Rubenstein said.

“I do not know if we will reach a decision immediately, request more investigation, take some time to decide, or other possible courses of action,” said Rubenstein, declining to proofer a timeline for a resolution to this case. Deputies Michael Hand and Phil Peterson have been on paid administrative leave since April 30th.

The incident which took place on April 24th, at Central High School involved Mesa County Sheriff’s School Resource Officers placing a student into a chokehold, banned under Colorado law, taking him to the ground, and threatening him with a Taser. The incident only came to light after video taken by students surfaced on social media.
